The amount of information that you provide to NCSF will vary depending on the information you require. Particular sections of this site may require you to send us your name, address and e-mail address so that you may properly utilise the service.

NCSF is committed to providing you with the highest levels of customer service. This includes safeguarding your privacy. NCSF is bound by the following National Privacy principles that relate to privacy:-

Collection, Use and Disclosure, Data Quality, Data Security, Openness, Access and Correction, Identifiers, Anonymity, Transborder Data Flows and Sensitive Information.

Our Privacy Statement states that we will:-

  • Only collect information that is necessary for what we do
  • Be fair in the way we collect information about you
  • Tell you who we are and what we intend to do with information about you
  • If we collect information about you from someone else, we will make sure you know we have done this
  • Only use and disclose information about you in ways that are consistent with your expectations or are required in the public interest
  • Ensure that information about you is accurate when we collect or use it
  • Keep information about you secure
  • Be open with you about what kinds of personal information we hold and what we do with it
  • Wherever possible, let you see the information we hold about you and correct it if it is wrong
  • Limit our use of identifiers that government agencies have assigned to you
  • Wherever practicable, let you have the option to interact anonymously
  • Take steps to protect your privacy if we send personal information about you outside Australia
  • Obtain consent for the collection of sensitive information about you

 


Collection of Personal Information

NCSF will do everything we can to meet these principles but if we do not please tell us and we will try and resolve any problem you may have.

NCSF hold personal information such as your Tax File Number (TFN), your personal contact details, health information and financial information. An explanation of this personal information is as follows: -

Tax File Number (TFN): The purposes for collecting your TFN are for taxing eligible termination payments at concessional rates and passing your TFN to the Australian Taxation Office (ATO) when notifying contribution details for Surcharge Tax, and other taxation purposes required by law.

Personal Contact Details: Name, address and date of birth to establish your superannuation account.

Health Information: This information may be requested should you decide to apply for additional insurance cover or lodge a claim for Income Protection Benefit or in the event of death.

Financial Information: The contributions that you or your employer contributes. (This may include any rollovers received from other superannuation funds)

The primary purpose for the information you provide to the Trustee is used to admit you as a member of NCSF and provide benefits from the Fund to you. In addition to collecting personal information from you, NCSF may also collect your personal information from the following parties:

  • Your current and past employer
  • Your doctor, and
  • Your union delegate

 

NCSF is required to collect your personal information under the provision of the Income Tax Assessment Acts 1936 and 1997, Superannuation Industry (Supervision) Act 1993, Superannuation Guarantee (Administration) Act 1992 and the Family Law Act 1975. If you do not provide all the information requested by the Fund we may not be able to process or assess your request.

 

 

Use and Disclose of Personal Information

Personal Information collected by the Fund may be passed onto certain third parties in the ordinary course of activities of the Fund. Examples of the types of organisations to whom it may be necessary to disclose your personal information include:-

  • Administrator
  • Insurer
  • Auditor
  • Organisations that provide mailing services, maintenance of our information technology systems and printing of our standard documents and correspondence
  • Solicitors
  • Commissioner of Taxation
  • Employers
  • Other superannuation funds to which member benefits have been transferred
  • To members’ spouses to whom details of a member may be required to be given under the Family Law Legislation Amendment (Superannuation) Act 2001 and the Family Law (Superannuation) Regulations 2001


Your personal information will not be used or disclosed for any other purpose unless we have your consent.

Your personal information may be used for direct marketing purposes. You may object or decline to receive any further information that does not relate directly to superannuation you may also access, correct or update your personal information at any time. Data Quality

NCSF will take all reasonable steps to make sure that the personal information we collect, use or disclose is accurate, complete and current.

NCSF periodically issues reports to its members regarding NCSF, the members’ benefits and rights under the rules of NCSF. If any of your personal information is inaccurate in these reports, we would appreciate you notifying us as soon as possible.

 

Data Security

NCSF will ensure that the personal information collected is secure from loss, misuse or unauthorised access.

Access to client information will be restricted to those authorised staff that requires access to carry out our primary or secondary purpose.

NCSF will take all reasonable steps to destroy or permanently de-identify personal and/or sensitive information if requested by the subject of the information and it is no longer needed for any purposes of the organisation. This could include encryption of emails, utilisation of passwords internally and restricting access to certain types of information.

Material that may contain personal and /or sensitive information is to be disposed of in one of the following manners:

Shredded
Placed in Security Document Destruction Bags
Placed in Security Shredding Bin (Secured by lock and key)

An annual audit is carried out by NCSF to ensure data security is disposed accurately.

Any information that NCSF disclose to various third parties is safeguarded by the existence of contractual arrangements.

 

Access And Correction

All information concerning our clients is to be considered confidential. NCSF will not convey any information contained in our records to any unauthorised person.

NCSF must establish the identity of the person to ensure that they are who they say they are and have the right to be sent information.

There are various ways in which information may be requested.

In Person – the identity of the person can be verified by a driver’s licence, which provides a photo, signature or credit cards carried on the person.

By Phone – the identity of the person can be verified by asking personal details of the member or information held to establish that they know the particular information that should be familiar to them. Information sent to the person should only be sent to the postal details held.

Any sensitive information must not be released without a written request from the owner of the information.

Letter, Email, Fax - the identity of the person can be verified by the address, with information being returned to the held address.

Administrator/Insurer/Auditor the release of information is prohibited if:-

a) we do not hold a letter of authority from the individual requesting that we release information to the respective organisation.

We will not provide clients with access to personal information where it: -

a) poses a serious and imminent threat to life or health
b) would have an unreasonable impact upon the privacy of others
c) is frivolous
d) would be likely to prejudice investigation of unlawful activity or where denial of access is permitted by law.

If information is connected with a commercially sensitive decision making process NCSF may provide an explanation rather than provide direct access.

NCSF will convey to the client our reasons for any denial or correction of information.

Where a client is not satisfied that NCSF have declined to provide information they can use our internal disputes resolution process. (Refer to Dealing With Complaints section)

Where a client is asked to pay for the preparation and retrieval of their personal information the cost is to be fair and reasonable. No cost shall be charged when lodging a request for access to the information.

 

Identifiers

NCSF will use our own identifiers and not those assigned by the Government unless we are required to do so.

NCSF will not disclose an identifier assigned by a Government agency, unless the disclosure is: -

a) to prevent or lessen a serious and imminent threat to a clients life or health
b) to advise relevant authorities where unlawful activity is suspected
c) required or specifically authorised by law
d) reasonably necessary for the enforcement of criminal law or imposing a pecuniary penalty or for the protection of public revenue

 

Anonymity

NCSF will wherever it is lawful and practicable give people the option to operate anonymously.

In some circumstances there will be legal obligations that require identification of the individual.

 

Transborder Data Flow

NCSF will only transfer information outside Australia if: -

(a) we reasonably believe that the recipient of the information is subject to a statute, binding scheme or contract which effectively upholds principles for fair information handling that are substantially similar to these principles; or

(b) the client concerned consents to the transfer;

(c) the transfer is necessary for the performance of a contract between the client concerned and NCSF, or for the implementation of precontractual measures taken in response to the client’s request; or

(d) the transfer is necessary for the conclusion or performance of a contract concluded in the interest of the client concerned between the organisation and a third party; or

(e) the transfer is for the benefit of the client concerned, and

(i) it is not practicable to obtain the consent of the subject of the information to that transfer; and
(ii) if it were practicable to obtain such consent, the subject of the information would be likely to give it

(f) NCSF has taken reasonable steps to ensure that the information, which it has transferred, will not be collected, held, used or disclosed by the recipient of the information inconsistent with these principles.

 

Sensitive Information

NCSF will only collect details relating to your health or trade union membership in the following circumstances:

  • The individual has consented; or
  • The collection is required or specifically authorised by law; or
  • The collection is necessary to prevent or lessen a serious and imminent threat to the life or health of any client, where the subject of the information is physically or legally incapable of giving consent; or
  • The collection is necessary for the establishment, exercise or defence of a legal claim, or
  • The information is necessary to provide a health service to the individual,: and
  • The information is collected as required by law (other than this Act), or
  • In accordance with rules established by competent health or medical bodies that deal with obligations of professional confidentiality which bind the organisation,
  • The collection is necessary for any of the following purposes,
  • Research relevant to public health or public safety,
  • The compilation or analysis of statistics relevant to public health or public safety,
  • The management, funding or monitoring of a health service, and
  • That purpose cannot be served by the collection of information that does not identity the individual or from which the individual’s identity cannot reasonably be ascertained, and
  • It is impracticable for the organisation to seek the individual’s consent to the collection, and
  • In accordance with guidelines approved by the Commissioner under section 95A for the purposes of this subparagraph.
  • If an organisation collects health information about an individual in accordance with subclause 10.3 of the NPP’s, the organisation must take reasonable steps to permanently de-identify the information before the organisation discloses it.
  • Non-profit organisation means a non-profit organisation that has only racial, ethnic, political, religious, philosophical, professional, trade, or trade unions aims.

 

NCSF will treat this matter as confidential and will only use the information for the primary purpose for which it was collected or a directly related secondary purpose.

How to lodge a complaint about possible breach of privacy

If you have a complaint or a concern about privacy please contact the NCSF Privacy Officer. All complaints will be handled promptly and discretely.

 

Our Commitment To You

We will take every step necessary to ensure your enquiry or complaint is dealt with fairly and properly in a timely manner.

Your complaint will be considered and dealt with within 15 working days.

Using the website

When someone browses the NCSF website, our website service provider logs certain information about the website visit for statistical purposes for example:-

  • The person’s server address
  • Top level domain (eg.com, gov, au)
  • The date and time of the website visit
  • Pages looked at and documents download
  • Previous site visited
  • Type of browser used
  • NCSF will not try to identify users or their browser activities except in the event of an investigation where a law enforcement agency may exercise a warrant to inspect the service provider’s logs.

 

NCSF website is “cookie free”, which means it does not insert any devices into the user’s browser to provide the website with information about the user’s browsing patterns preferences. NCSF will not send website users any unsolicited information after they have visited the website.

NCSF will only record a person’s email address, whether provided on the website or by other means if they advise NCSF that they wish to receive email communications from NCSF. A person can “unsubscribe” at any time when they receive an email communication from NCSF.
